Litigation is the foundation of O’Reilly & Mark’s success. We advise our clients, however, in taking certain measures to avoid or minimize costly litigation where possible. In this respect, we provide guidance on how best to reduce liability exposure in light of recent legal trends and other significant developments. We also evaluate the feasibility of less expensive alternatives to litigation, including but not limited to, mediation and arbitration. Our Civil Litigation Practice Group handles a wide variety of complex cases and represents a diverse group of clients in disputes arising in all areas of the firm’s practice. Our trial attorneys have appeared in state and federal trial and appellate courts, bankruptcy courts as well as regulatory and administrative agencies.
Our trial attorneys develop litigation strategies to the specific needs of the client and the facts of each case. We strive to achieve results that best meet the client's particular needs. We insure that our client is advised throughout the litigation process.
We have significant experience representing both plaintiffs and defendants in litigation involving internal business disputes, fiduciary duty issues, theft of corporate assets, fraud, conversion, negligence and related civil causes of action.

Our litigators regularly represent employers on both sides of unfair competition issues by drafting restrictive covenants in compliance with applicable state law, analyzing the restrictive covenants of potential new employees and structuring their employment to minimize litigation risks, litigating non-compete agreements, non-solicitation agreements, nondisclosure and confidentiality agreements, common law causes of action, such as tortious interference with contractual relations, tortious interference with business expectancies, misappropriation of trade secrets, breach of fiduciary duties and breach of duties of loyalty.
